CHALLENGE TO CAFO MASTER MATRIX
Six Republican members of the Admin Rules committee will be filing an
objection to the DNR rules on the master matrix, claiming it violates the
laws' intent of one minimum score. This objection comes a week before the law
is to become effective. What this means, according to the Administrative
Rules Review Committee Powers, if the master matrix is challenged in court,
the objection strips away the presumption of validity that is normally
accorded administrative rules, and forces DNR to prove the legality of the
master matrix. The next Admin Rules committee meeting will be Friday, Feb 21
at 8:45 AM.
