The Farm Bureau's lawsuit to void the antidegradation rule adopted by the EPC is scheduled for a hearing on January 18 at 9:00 a.m. at the Polk County Courthouse. The Attorney General, representing the DNR and EPC, has filed a motion for summary judgment. The Iowa Chapter has intervened to support the DNR and EPC in upholding the rule. The motion for summary judgment asks that the court rule in our favor without a trial because the facts and the law are clearly on our side. Farm Bureau and its partners have resisted the motion for summary judgment. At the hearing on the 18th the judge will hear arguments from the attorneys in support of their respective positions. 


I believe the hearing will be in Courtroom 307 at the Polk County Courthouse. The judge is Mary Pat Gunderson. We are on our third judge in the case. The first judge, Judge Novak retired last year. Judge McCall then got the case. Now, with Judge Gunderson recently appointed by Governor Branstad to replace Judge Novak, she has been assigned to the case.
