Notice of Public Hearing
The DNR Water Supply Section intends to amend six existing chapters of the
Iowa Administrative Code (IAC 567). The proposed rules were presented at
the May 15th meeting of the Environmental Protection Commission, where six
public hearings were approved to receive public comments. The chapters
were printed in the June 14th Iowa Administrative Bulletin, and are listed
below:
Chapter 40: [Water Supplies] Scope of Division – Definitions – Forms –
Rules of Practice
Chapter 41: Water Supplies
Chapter 42: [Water Supplies] Public Notification, Public Education,
Consumer Confidence Reports, Reporting, and Record Maintenance
Chapter 43: Water Supplies – Design and Operation
Chapter 81: [Certified Operators of] Public Water Supply Systems and
Wastewater Treatment Plants
Chapter 83: [Environmental] Laboratory Certification
The U.S. Environmental Protection Agency (EPA) has promulgated new and
revised drinking water regulations requiring rules in the areas of
disinfectants/disinfection byproducts, interim enhanced surface water
treatment, and analytical methods. The reauthorization of the federal Safe
Drinking Water Act in 1996 necessitated revision of the operator
certification program, along with other changes identified during the
chapter review. Since the DNR has the primacy responsibility for the
implementation of the SDWA in Iowa, the rules must be updated to reflect
these changes to the federal regulations.
These amendments include:
adoption of the federal disinfectants/disinfection byproducts rule
adoption of the federal interim enhanced surface water treatment rule
new and amended definitions, some of which are adopted as a result of EPA
mandates, others of which are adopted for clarity
corrections as a result of the EPA rule review
elimination of the special lead ban public notice requirement
update of the operation permit fee rule and inclusion of a late fee
analytical methodology updates
revision of the operator certification rules (rescind the current Chapter
81, and adopt a new Chapter 81)
increase in fees
update drinking water treatment and distribution operator requirements,
partially due to the reauthorization of SDWA
rescind both the 1R classification for drinking water distribution
operators and the allowance for certification without examination
amend definitions
adoption of a new Grade A classification for very small water supplies
revision of the education and experience requirements
incorporate the disciplinary actions procedures consistent with other IDNR
enforcement actions
amend the operator-by-affidavit rule
Advisory committees composed of representatives of water utilities,
professional and technical organizations, industry groups, and regulatory
agencies reviewed the proposed rules, over the past six months. Copies of

The hearing for Chapters 40-43 and 83 will be held first, followed by the
hearing for Chapter 81. Persons will be asked to give their names and
addresses for the record, and to confine their remarks to the subject of
the rules. Any persons who intend to attend a public hearing and have
special requirements such as hearing or mobility impairments should contact
the DNR with their specific needs.
