According to the Des Moines Register today, this bill did not make it through the "funnel" deadline. Perhaps Lyle can give us an update on that and his opinion of whether or not it will emerge in some other form. I don't think we would "support" this bill, however. The DNR had recently come to a compromise agreement with the cattlemen's association to phase in enforcement of long-unenforced federal Clean Water Act permit requirements. DNR and the Cattlemen's Association agreed to a voluntary registration and amnesty program for open feedlots. Under the agreement, DNR will relax enforcement of environmental requirements for registered sites as long as the feedlot owner is making reasonable progress toward compliance. This voluntary registration and amnesty program was agreed to just a few weeks ago. But, the bill, SF 503 would not allow the DNR to carry out the compromise agreement because the net effect is that DNR would lose the ability to require corrective measures to protect water from manure contamination on almost all open feedlots, either with or without permits. According to Perry Beeman in the DM Register, the bill would ban the state from controlling polluted runoff from feedlots unless the state or federal government pays for most of the work. Mark Lambert of the Iowa Environmental Council said "feedlot operators have had nearly 30 years to get the required permits and to control runoff."
