There is no legal or practical basis for having different rules for open
feedlots as opposed to confined animal operations. We should work on eliminating
this distinction. The issue is the concentration of animals in one place, not
whether the operation is open or confined. In fact, CAFO stands for concentrated
(not confined) animal feeding operation.
