HSB 168, An Act providing for public comment regarding an application  
to construct a confinement feeding operation structure.

This bill amends Code section 459.304 which allows a county board of  
supervisors to review an application to construct a confinement  
feeding operation structure (a confinement building or manure storage  
structure) and comment upon it to the department of natural resources  
before the department determines whether to issue the applicant a  
construction permit.  As part of the review process, the board may  
hold a public hearing concerning the application.  The bill requires  
the board to conduct the public hearing and submit comments presented  
there to the department.

The types of comments presented at a public hearing may include but  
are not limited to the existence of an object or location that are in  
proximity to the construction site, the suitability of soils and the  
hydrology of the construction site, the availability of land for  
manure application, and whether construction will impede drainage  
systems.

While it is not a lot, it is all that is possible this Session. We  
need this bill out of House Environmental Protection Committee this  
week! Please call your legislator at, 515-281-3221, or email your  
legislator below, and ask them to get this bill out of the House  
Committee. If you live in the districts of Reps. Gayman or Reichert  
(Scott or Muscatine counties) please especially make this contact, and  
please get others you know to do so as well. Their votes are critical  
to our success. They were endorsed by Sierra Club in the last two  
elections (for your info.)
