Here are the bills I am tracking for Sierra Club so far introduced this
session with actions occurring accum- ulated in the narrative. Note
that I include the Bill #, Bill Title, some notes of milestones. These
are the bills that remain viable after the Funnel deadlines.
DNR DIRECTOR Paul Johnson was confirmed with no problem.
NATURAL RESOURCES COMMISSION Members Carol Kramer, William Sullivan,
Paul Christensen were all confirmed by the Senate.
ENVIRONMENTAL PROTECTION COMMISSION Members Gary Priebe, Rita Venner
and Elizabeth Christensen were confirmed. James Braun was confirmed on
the Individual Confirmation Calendar.
BOTTLE BILL RUMOR. We had heard that there be a House Ways & Means
Committee bill to eliminate wine bottles from the Container Deposit
Law. It was drafted but not introduced. I organized a quick coalition,
met several times, and we counted votes on the Ways & Means Committe,
and have the bill stopped. We did find surprising support among GOP
members for potential expansion of the law next year to include
additional containers for deposit.
REAP & INFRASTRUCTURE APPROPRIATIONS. There were no subcommittee
meetings again this week. The Governor has told legislative leaders
that he supports keeping REAP separate from the non-REAP Allocation
Formula projects and to fund REAP at the level that they are
comfortable with. The REAP Alliance position is that the REAP
Allocation Formula should be the only item under the REAP category and
to support the Governor's recommendation of $15 million. If it means
that supporters must take less dollars than the $15 million to keep
REAP separate from the other projects, the Alliance would support that
move. To include the other non-REAP projects could start the slippery
slope of reducing the REAP Allocation Formula in the future for
non-REAP projects, but allow the General Assembly to call it REAP in
the budget.
Right now the altered "REAP" is $20.475 million, with $9.9 million for
other projects that should be funded under the Natural Resource
category and $10.5 mil for the REAP allocation. (In the $9.9 million is
water quality monitoring, increased cost-share funding to voluntarily
close ag drainage wells, soil conservation, the watershed protection
program, and other funding proposals by members of both parties for
better natural resource protections, but that should be moved out of
"REAP" and to the Natural Resources section of the funding bill.)
Tell your legislators if they are on the following subcommittee or in
leadership to have REAP stand on its own and move the other spending to
the Natural Resources component of the bill. Second, support the
Governor's level at $15 million for the REAP allocation formula, plus
license plates and interest. Budget subcommittee members are: Senators
Freeman (Chair), Jensen (Vice Chair), Connolly (Ranking Member),
Johnson, Shearer; Representatives Sukup (Chair), Rayhons (Vice Chair),
Cohoon (Ranking Member), Bukta, Horbach, Huseman, Kuhn, Warnstadt,
Weidman.
Infrastructure appropriations will probably be among the final items of
the session.
WATER QUALITY MONITORING. Governor Vilsack proposed a good beginning --
$1 million this year to plan and begin the program, then $2 million
annually. Funding for water monitoring is part of the Transportation,
Infrastructure, and Capitals appropriation. This funding should be
moved to the Natural Resources component of the appropriations bill,
leaving the REAP formula intact. Contact your local legislators and let
them know funding water monitoring (at a minimum $1 million level this
year) is vitally important.
HF 218, LOESS HILLS ALLIANCE.. The 30 years easement language did
remain. It also still requires annual easement payments. Eligible HF
substituted for SF and deferred. SF version is simplified & preferred
form without the 30 yr. easement restriction and without the annual
payment requirement. H version creates the Loess Hills Alliance;
creates Loess Hill Development and conservation fund to fund a Loess
Hills Account and a Hungry Canyon Account; requires the alliance to
study protection of the natural and cultural resources of the Hills
while preserving economic viability and private property rights;
requires development of a comprehensive plan with options including
federal or state park designations and restrictive easements of no more
than 30 years; to establish a pilot project and to report to the
Legislature; requires Alliance members to live in Woodbury, Plymouth,
Monona, Harrison, Pottawattamie, Mills or Fremont counties plus other
environmental, farm, banking and tourism organizations. Senator Hansen
has several amendments to help bring the bill back to the intent of the
Alliance. S-3170 seems to include most of the main issues.
HF 476, FARMLAND CONDEMNATION. Prohibits the condemnation of farmland
for "private" use unless the owner of the land consents, and defines
recreational trails as a private use therefore requiring landowner
consent to condemn if the land is agricultural. The definition of
farmland is 10 acres or more used for the production of ag commodities.
The amendments to allow condemnation for trails were defeated on an
urban/rural split. The House is expected to maintain their position
against trail condemnation.
HF 746, DALS & DNR APPROPRIATIONS. Some of the funding includes: DALS -
Soil Cons. Div. - $6.8 million; DNR - Parks & Preserves - $6.2 million;
Forestry - $1.7 million; Energy & Geology - $1.9 million; Env.
Protection - $4.9 million; Water Quality Project - $0.7 million. A
provision in the bill requires the DNR to amend its agreement with the
USDA concerning wild animal control to include white tail deer.
